At age five, 1954, "the Bishop" (Chicago's Cardinal Stritch) stood over me and said, I had to "stop babbling" about what the priest did to me. It took me 40 years to talk about it again. Today, I babble.

Why stop at Polanski? Extradite Cardinals Law & Levada as well; plus Capozzi play reading December 11th in New York

*
By Kay Ebeling

"First indict Cardinal Roger Mahony for aiding and abetting about a hundred pedophiles in Central and Southern California." (Comment posted on a Hollywood Reporter story saying Roman Polanski may voluntarily be extradited.)

Note the cool graphic above the headline here at City of Angels announcing a performance of “For Pete’s Sake” in New York, as a benefit for Road to Recovery. Reading of the one-act play will be December 11th, 8PM in Manhattan at 2 West 64th Street, the NY Society for Ethical Culture ceremonial hall. Wow. Tickets are $15 and the show is a fundraiser for Road to Recovery, the East Coast nonprofit that provides direct support to survivors of pedophile priest sex crimes.

Somewhere in New Jersey there are likely more victims of Monsignor Pete Cheplic, namesake of "For Pete's Sake." Playwright Joe Capozzi talked to City of Angels recently: “I hear from people,” Capozzi said. “I know he’s had guys suddenly pull out of his life, guys he was close to all of a sudden once they get married, they cut him out, for whatever reason. I know he had relationships with a bunch of other guys. Was it the same with them, I don't know, unless they want to come out and say. They were the same age range, they would also go drinking with Cheplic and to dinner.”

Announcing the upcoming reading, Joey wrote: "For Pete's Sake" is a story of a young man who chose to keep a secret without realizing how it would affect the rest of his life. Twenty years later he's getting divorced, quit his job and is finally forced to deal with the truth about his life long relationship with his Priest. Dealing with the church, the press and his family was only the beginning. Being honest with himself would be his greatest challenge. "For Pete's Sake" is an honest and humorous look at his journey

City of Angels wrote about "For Pete's Sake" in the October 9th post.

Writing on the Web about Roman Polanski

At work I'm transcribing interviews regarding the film The Ghost, which will be released in 2010 if Roman Polanski is able to complete production from a Swiss prison. Often when I'm doing my TV job, I end up hearing something I need to hear for the project of writing these blogs.

Today’s job - well shoot, I'm not allowed to reveal anything from what I transcribe for TV shows while they are in production. But I can say that in one of the interviews I worked on, a cast member of The Ghost made a remark which I'm paraphrasing here:

"If your life depends on something, you make sure you are good enough, even if it’s something at which you're not natural." She said, "It’s amazing what skills you can acquire when it’s life or death.”

She's talking about the character she plays, but that quote stunned me today and lit my fire.

After the Illinois Supreme Court decision early last October, it seems people born before 1964 in Illinois are SOL as to the SOL, as far as civil lawsuits regarding pedophile priests in that one state.

So now that I know I'm probably not going to get a settlement from the Chicago Archdiocese, my life depends on doing something else to pull myself up, I mean poor people die young, so I’ve got to do something fast.

It is life or death, my life depends on it.

At City of Angels 2 I'm developing something.

Like the woman in the quote: I can’t be held back by the fact I don't know what I'm doing, my life depends on this, I have to create something that pulls me up,

So, stay tuned to City of Angels 2.

I hope 'Sunset Boulevard' will grow into an online book, or some new thing that because it's online, it has not really been invented yet, but it is sort of a living book.

I don't know what the end result will be but I'm posting it there, posting it every day

Like dailies.

Some of the scenes will be rewritten, some of the events described may never be referred to again. And as you will see at the top of the page, “This Story is Available for Sale to be made into a major motion picture."

MEANWHILE

With all the news about Roman Polanski, I recently went on a frenzy, going to every story I could find about the convicted pedophile on the lam, to put in a comment. If anyone wants to try the same project, here is a sample of what I’ve been posting. However, I'm not necessarily toting a party line here, and I'm sure others in the survivor community do not agree with me, here goes:

In the USA, pedophile Catholic priests performed worse crimes than Polanski’s, many with similar MO's - drugs, isolating the child from parents, etc. If the USA really wants to prosecute pedophiles, indict Cardinal Roger Mahony of L.A. Extradite pedophile aiding and abbettors who are now hiding out at the Vatican, such as William Levada and Bernard Law. It's easy to go after Polanski, let's see some real muscle in law enforcement, go after the real source of most of the pedophilia in the USA, the Catholic Church. . .

Another comment on a Hollywood Reporter story saying Polanski may voluntarily be extradited:

First indict Cardinal Roger Mahony for aiding and abetting about a hundred pedophiles in Central and Southern California. Catholic priests preyed on parish families all over the state, and committed sex crimes against hundreds of children, much worse than Roman Polanski. Read City of Angels blog for more...

At another news outlet:

There are about a thousand pedophiles that have not been prosecuted right now in the USA. What these Catholic priests did to kids the last 40 years was 10 times worse than Polanski's crimes, and at least the director has admitted guilt. The priests, many of them serial felons, often live in luxury today and even continue to run schools and parishes.

Polanski's victim does not want him prosecuted or any more news coverage. Many of us priest victims WANT our stories told...

Another one at the Hollywood Reporter:

I posted a true crime story yesterday at City of Angels about two Catholic priests out of the five thousand who got away with serial pedophilia in the US in the last fifty years.

If we really want to extradite pedophiles, there are plenty felons involved with American pedophile crimes hiding at the Vatican or living lives of luxury around the country, with a news media that is afraid to run stories about their criminal activity. Please read city of angels blog for the truth, Roman Polanski's crimes are nothing compared to these guys.

Then at Los Angeles Times:

The news media refuses to run stories about the worst pedophiles ever to operate in America, Yesterday at cityofangels5 . blogspot . com I put up a story about two Catholic priests who operated in Louisiana. There were 5000 pedophile priests preying on parish families in the last 40 years in this country, (see bishopaccountability . org )

If the USA really was concerned about sex crimes against children, law enforcement would stop caving to Catholic Church pressure and prosecute felony bishops, monsignors, etc.

What Roman Polanski did was nothing compared to the epidemic of pedophile Catholic priests.

(Note: The L.A. Times did not post any of the comments I wrote on their site to any of the stories.)

ANOTHER COMMENT:

The issue here is rich & powerful people getting away with crime and crime victims not getting justice. What Polanski did is not half as bad as the 5000 Catholic priests who raped children in the USA and the bishops who let them do it. I'm one of the priest victims and what I see here is an imbalance of justice.

If we overlook the epidemic of pedophilia in the Church, we have no credibility prosecuting Polanski.

NOTE THIS POINT:

As recently as this week, the victim has said she does not want Polanski extradited, shw wants the whole story to go away, the media frenzy is making her sick.

Roman Polanski's victim asks court to drop charge against director
October 26, 2009 2:19 pm
The victim of Roman Polanski’s 1977 sex charge has asked an appellate court to drop the charge against the film director, saying the unceasing publicity has disrupted her family, job and health.

Since the director’s arrest last month, Samantha Geimer and her attorney have received close to 500 phone calls from media as far as Germany, Israel and Japan, attorney Lawrence Silver wrote in a statement filed Friday.

Larry King and Oprah have beckoned, and photographers have been camped outside her Hawaii home, trying to take photos or video through holes drilled in their cars and offering gifts to her children in exchange for information, Silver wrote.

“This statement makes one more demand, one more request, one more plea: Leave her alone,” Silver wrote in the filing.

Polanski victim wants case to go away -- is she right?

From Huffington Post this morning:

From the classical French point of view, the US is criminally puritanical about sex as opposed to France , with its own more "liberal" wink-an-eye espousal of affairs under the sheets. The extent of this prejudice is so great that most popular French papers -- such as "Le Monde" and Liberation -- have chosen to distort the facts when reporting on the case. Liberation described Polanski's crime as an "affaires des moeurs", a banal case of mores, rather than a convicted case of "illegal sex with a minor". Le Monde describes what happened as "Polanski's relations with a young girl," forgetting the word "illegal

Today a crime like Polanski's would receive a much harsher sentence than in 1978. Now, if Polanski returns for sentencing, legally the most he himself could receive is two years.

Attempts to stop Loomis from testifying on Mahony caused release of deposition last week, Motion for Order re Don Woods

*
By Kay Ebeling

A Law and Order Moment caused release of the Richard Loomis deposition transcript last weekend, not a "stunt" by plaintiffs, as a church attorney claimed in court Tuesday. Inappropriate and "bizarre" behavior by Donald Woods Attorney for the L.A. Archdiocese at that deposition caused a transcript to become relevant and able to be entered into the public domain, attached to a motion about Woods' behavior.

“Despite Monsignor DOE 6’s attempts to pull away, Mr. Woods began to whisper in his ear,” reads the Motion for Protective Order filed by Plaintiffs to which the transcript was attached. “Mr. Woods’ bizarre and improper conduct was a blatant attempt to stop Monsignor DOE 6 from continuing to give damning testimony regarding Cardinal DOE 1, who Mr. Woods also represents in this same matter.

“Plaintiff must be allowed to elicit this critical testimony from Monsignor DOE 6 an other DOE defendants without interference from Mr. Woods’ improper, unreasonable, and disruptive conduct.

Plaintiffs say Woods also coached the witness, physicaly restrained him, instructed him not to answer more than fifty times on shaky grounds:

“During virtually every portion of the deposition where this testimony was being elicited, defense counsel, in violation of local rules and the rules of civil procedure, attempted to thwart the testimony, transparently coach the witness, and at one point, physically restrain the witness from testifying.

“In addition to the awkward hand movements which occurred on two separate occasions, Don Woods repeatedly obstructed the deposition process.”

I was working on a story about the Tuesday hearing, and I got to this quote in my notes:

Steier: Over the weekend there was a stunt, they created a motion and attached a transcript, and then sent it to the media.

I went back and reread the motion to which the deposition was attached last weekend, when I like every other writer on this topic, focused all my attention on the Monsignor’s deposition.

The real story is the bizarre behavior of Donald Woods.

So this post is going up tonight, and the story on the hearing Tuesday will go up tomorrow, unless something else comes up, that's life on a blog.

Meanwhile, here are quotes from:

Motion for Protective Order Regarding Donald Woods.

Plaintiffs need a court order to “Prevent Donald Woods, counsel for the Archdiocese Defendants DOE’s 1 through 20 (except 3 and 8) from “Engaging in improper, disruptive, and unreasonable conduct during the course of Monsignor DOE 6’s deposition (That's Monsignor Loomis).

“Mr. Woods’ repeated behavior in attempting to silence DOE 6 and preventing him from giving testimony that is extremely damaging to the Archdiocese defendants is improper and a blatant misuse of the discovery process and violates the California Rules of Civil Procedure and the Los Angeles County Superior Court Rules.”

Dated September 17, 2009:

Introduction:

“This case involves a longstanding cover-up by Archdiocese Defendants and specifically Cardinal DOE 1 of knowledge of DOE 3’s sexual abuse. DOE 3 is currently serving a ten year prison sentence, in part for brutally raping a child, plaintiff Luis C, over the course of several years.

The deponent in this case was Monsignor DOE 6.
“DOE 3 was caught red-handed with Luis C. in his parish living quarters in a parish in direct violation of archdiocesan policy in 1996. Despite this disclosure Cardinal DOE 1 did not remove DOE 3.

“On September 15, 2009. Plaintiff conducted the first session of DOE 6’s deposition. During the course of that deposition, counsel for Archdiocese Defendants, Mr. Donald Woods, behaved improperly and unreasonably and such behavior was disruptive and a misuse of the discovery process, such that a protective order is needed-

“To ensure that Mr. Woods be foreclosed from causing any further disruptions by virtue of his improper conduct.

“Monsignor DOE 6, the deponent, was being questioned by counsel for Plaintiff regarding Cardinal DOE 1’s deviation from the Archdiocese of Los Angeles’s own policies and procedures.

"A representative of the Archdiocese is required to publicly inform parishioner that a priest serving in the Archdiocese has been credibly accused of sexually abusing a child. In this case DOE 3, one of the most notorious priest pedophiles in the country.”

(SIDE NOTE: Every Archdiocese thinks they have “the most notorious pedophile priest in the country.” Truth is there are prolific pedophiles on the consciences of every bishop, archbishop, cardinal, and monsignor in the country, there are “the worsts” in every archdiocese. It’s astounding that the national nature of these crimes has not yet reached the American psyche.)

Back to:

Motion for Protective Order from Donald Woods

“Monsignor DOE 6 was describing how Cardinal DOE 1 specifically ordered Monsignor DOE 6 not to make the required announcements. This fact has never been previously disclosed.

“Prior to Plaintiff’s counsel completing his line of questioning, Mr. Woods, in a bizarre display, moved extraordinarily close to Monsignor DOE 6, wrapped both of his arms around Monsignor DOE 6 (to the visible surprise and dismay of Monsignor DOE 6) and, despite Monsignor DOE 6’s attempts to pull away, Mr. Woods began to whisper in his ear.

WOODS Whispered in the Monsignor’s Ear in the Middle of Deposition Questioning!!!

(I hardly EVER use exclamation points, because the best writing instructor I ever had said, the words should be powerful enough you don't need exclamatino points.

Exclamation points should only be used when they're needed, and in this case they're needed!!!)

Talk About Obstruction of Justice

More Quotes From:

Motion for Protective Order Re Attorney for Los Angeles Archdiocese, Donald Woods

“Despite Monsignor DOE 6’s attempts to pull away, Mr. Woods began to whisper in his ear.”

Phew. Read the end of this post to see why I'm saying Phew.

“Mr. Woods’ bizarre and improper conduct was a blatant attempt by Mr. Woods to stop DOE 6 from continuing to give such damning testimony regarding Cardinal DOE 1, who Mr. Woods also represents in this same matter.

“Mr. Woods improperly attempted to first silence, and then coach Monsignor DOE 6’s answers, in a clear misuse of the discovery process.”

(Manly lists the information that Monsignor was disclosing, all of it new information about the Cardinal, all of it has been written about now in news media across the country since the deposition was released last weekend, and I stand corrected, Mahony did instruct Loomis not to call the police, it just comes at the end of the deposition. You can read hte deposition at the SNAP website in full.)

More quotes from

Plaintiffs Motion Requesting Protection From Donald Woods

(Not the real title; read end of post to see why I exaggerate)

“During virtually every portion of the deposition where this testimony was being elicited, defense counsel, in violation of local rules and the rules of civil procedure, attempted to thwart the testimony, transparently coach the witness, and at one point, physically restrain the witness from testifying.

“He instructed the witness not to answer on over 50 separate occasions. Frequently, the basis for this instruction was not privilege, not confidentiality, not privacy, but ‘irrelevant’ and ‘calls for an opinion’ and at one point Woods objected on the basis of something called the ‘pontifical secret.’

“Further, a review of the transcript will show that defense counsel repeatedly coached the witness on the record, suggested answers to the witness, and attempted to improperly thwart the legitimate inquiries of plaintiff’s counsel.

“Plaintiff intends to file a motion to compel as to specific instructions.

“However, there are numerous depositions scheduled and more that will be scheduled.

“Plaintiff does not believe it should be forced to endure the improper tactics of the Archdiocese and their lawyers in these depositions.

“Further, absent a motion for protective order, plaintiff will be forced to file a motion to compel in each and every deposition because of Defense conduct.

“Plaintiff is not seeking sanctions in this motion. While we believe the conduct is sanction able, grossly unfair, and improper, we believe it is not in the best interest of our client to get a ‘pound of flesh’ from defense counsel.

“We simply want to prepare our case for trial in compliance with the rules.

“These are certainly difficult cases and can provoke strong emotions on both sides. We believe if the court makes clear that the type of tactics at issue here are not acceptable, that it will put an end to it, and that punitive measures at this juncture will be unnecessary.

“Plaintiff must be allowed to elicit this critical testimony from Monsignor DOE 6 an other DOE defendants without interference from Mr. Woods’ improper, unreasonable, and disruptive conduct.

“In addition to the awkward hand movements which occurred on two separate occasions, Don Woods repeatedly obstructed the deposition process in violation of California Rules of Civil Procedure 2017.010 and Los Angeles County Superior Court Rule: 7.12, by excessive objections, inappropriate hand gestures, whispering in the witness’ ear, instructing the witness not to answer on grounds not involving privilege -

“All in an effort to hinder Plaintiff from discovering relevant and crucial information involving this longstanding cover-up by Cardinal DOE 1.

“When Mr. Manly attempted to meet and confer with Don Woods regarding this behavior and other discovery violations, Mr. Woods simply stated that it would be up to the Court to resolve this.”

OKAY CITY OF ANGELS HAS to interject here,

I know I am better off if I keep my personal stuff out of these stories

BUT

Mr. Woods needs to be advised also about his inappropriate behavior, and twitchy questionable hand gestures outside the courtroom as well.

As a matter of fact, after the hearings Tuesday as the attorneys, reporters (me and the woman from the Times), and others were moving as a group out of the courtroom into the hall. I was on my way to try to get an interview, when --

DONALD WOODS got inappropriate with me.

I wear this Army Navy Surplus vest, with lots of zippers, because it’s great when you have a camera and a phone and cosmetics and pens and all the things I carry- I love my Army vest.

Woods, comes up to me outside the courtroom after the hearing. He reaches out and says, “What are these for?” and then tweaks the zipper on my vest.

The Zipper that is right in the front of my vest. Getting WAY TOO CLOSE.

Donald Woods invaded my space way more than an intelligent person would unless he's doing it on purpose, outside the courtroom last Tuesday.

Hours later I was still trying to figure out what happened, and the only thing that stayed on my mind was, this guy has got to have read a little bit about me by now, my story has been up at City of Angels 1 and 2 now for 2 and a half years. He’s got to know I have PTSD and sex problems up the whazoo and he’s got to know-

He’s just got to know that was wrong.

My reaction? Like I said, I have PTSD.

I jumped about three feet away and then made a self deprecating comment about myself.

Inside I had just turned into the teenage girl who always evoked sexually demeaning responses from boys, not quite knowing what I was doing to cause it.

Donald Woods has to know about PTSD induced sexual problems a lot of survivors have as a result of the criminal behavior of his own clients, the enablers of pedophile priests in the Catholic Church.

Especially when it’s me, a survivor who has written her story and put it on the web for everybody to read, that Woods is twitching at.

Donald Woods needs to be told how to behave in public, as well as in depositions.

Okay, why do I put so much of my personal stuff online? Because I feel like with me, it doesn't matter. A lot of survivors of these crimes have secrets that they can’t let anyone find out, because they have families and friends and careers. But in my peculiar case my behavior from the crimes destroyed any chance for me to have families friends and careers.

So it doesn't matter if the world finds out. I can like martyr my story.

So it doesn't embarrass me if the world finds out that Donald Woods touched me inappropriately outside the courtroom last Tuesday - and there were witnesses. I'm beyond embarrassment.

Woods can't be allowed to get away with any of his stunts.

Here’s the sequence of events with Woods and me:

First, okay, I dress weird. It’s because I don't have a lot of money right now, and I don't want to wear K-Mart stuff, I still want to have a look that is me. So since I am a warrior so to speak, and because the garments are sturdy - okay I know it looks stupid, but when I'm carrying my camera I wear an army navy surplus vest with all these zippers and I may complete the fashion statement this fall by adding combat boots.

I'm not dressing to look pretty these days.

Donald Woods felt a need to comment on that. At first I thought he was just criticizing the way I dress, and I felt bad enough about that.

But there was that hand at the zipper on my chest. He said, “What are these for” and sort of flicked the zipper thing.

I jumped three feet, felt humiliated, not even connecting how inappropriate the hand gesture was sexually, I was just feeling embarrassed about the clothes I was wearing.

After jumping three feet, I said, “They're to hold my stuff.”

Trying to make light of the incident, trying to act like I'm not embarrassed.

For two days I was freaked.

Then I read this motion for a protective order because of Woods’ inappropriate hand gestures.

What's the matter, Mr. Woods? Are you developing Turret’s Syndrome?

I know, I know, in the American system of jurisprudence, even the worst criminals deserve a defense, I know I know these church attorneys are just doing their job. . .

And as a spiritual person, I know Someone Else is running this show. I know the reason I'm still alive today after all the perilous situations I got into is to do this reporting. I know that since starting this blog, often I’ll start looking one thing up, and I’ll find another thing that is much more relevant. A more experienced reporter will say that's just how research works.

But - it’s hard to explain.

Just that Someone Else is directing the outflow of this information. I don't start a post with an agenda, I just start writing down what's happening, and the horrors and criminal behavior reveals itself.

So what a funny coincidence that Don Woods was inappropriate with me three days before I open a document and read that there will be a hearing October 26th about how inappropriate Woods has been acting during depositions.

You know, Mr. Woods, after a decade or so of unemployment, you too might be wearing Army Navy Surplus clothes, and maybe by then I’ll have the book deal and the movie deal, and then

Will I laugh at what you're wearing? Yes.

Will I reach out and grab your balls? No.

Please give me the same consideration.

Loomis Deposition: Quoted in depth at City of Angels today

.
(It's hot, I finally got AC, so why go out, when I can go through the Deposition of Monsignor Richard Loomis from Tuesday September 15th released around midnight last night. Here are the salient quotes:)

Q: Why are you on leave?
A: I was accused of abuse.
(Loomis claims he employs himself doing proofreading from home, and he lives alone… John Manly remarks that the Monsignor is wearing clerics.)
A: I have never been instructed not to wear clerics.
Q: Okay. Are you engaged in a canonical process on the accusations against you?
A: Yes.
Q: And where does that process stand today?
A: It’s in Rome.
Q: Was there a trial held in Los Angeles?
A: Yes.
(Donald Woods objects on the basis of “pontifical secrecy.”)
MANLY: Do you have a legal objection?
WOODS: The next one I mentioned was not relevant to this case.

(Manly explains that since Monsignor was once Vicar for Clergy in charge of handling sex abuse claims for the L.A. Archdiocese, and he also had accusations against himself, “It goes to procedures, it goes to the competency of the Archdiocese in terms of who they put in leadership positions, so is your legal objection relevance?)

WOODS: It’s not our purpose to argue these things out here. But not only is it not relevant to this case, but it is also collateral. And it would lead us to a 352 issue.

A PONTIFICAL ISSUE
MANLY: 352 may be an issue at trial. Not in discovery. Monsignor Loomis has testified extensively in a prior deposition that I have a copy of about the accusations against him. There was a trial here, as I understand it, a canonical trial. And there was an outcome, which is in Rome one way or the other. I want to know, there was a finding of fact. I'm certainly entitled to ask that question.
WOODS: It is considered a pontifical order, a pontifical secret within the church. And it leads to collateral, all kinds of collateral issues.
MANLY: You're asking me to take your word for it. You wouldn't take mine and I'm not going to take yours. I'm asking you, what is a pontifical secret. Do I get Dan Brown and look there? What is it?
WOODS: We'll take it up before the court.
DONALD STEIER: Record should reflect the term First Amendment. Later we can debate it, but the record should be noted.
MANLY: Pontifical secret, the First Amendment, relevancy and what else?
STEIER: Well. 352.

THE CHURCH STILL KEEPING SECRETS
MANLY: In that canonical trial, who was the advocate for the church, or what’s it called in civil parlance, the prosecutor? Who were the judges?
A: I have been told that I am not supposed to reveal that under the canonical process.
Q: Told by whom?
WOODS: Again within the church, it’s something that is maintained confidential

(CofA: We are talking here about allegations of sex crimes against a Monsignor, that were never made public. In the Twenty-First Century )

Woods: All the people involved in the process have taken an oath to keep it confidential and unless it’s absolutely relevant-
MANLY: Can I get a copy of that oath?
WOODS: - to a civil proceeding and we have an order from the court, we're not going to go into it. I am going to instruct him not to answer.
MANLY: Can I get a copy of this oath?
WOODS: No.

(Manly says he’s not going to ask every question about the trial, then, since they're going to object. Steier opines that by law Manly should say every question for them to object to each one individually. Manly goes back to deposing Monsignor Loomis.)

Q: Have you been restored? What is your current status at the Archdiocese, Monsignor?
A: I'm on leave.
Q: How long have you been on leave?
A: Approximately a little over five years, that's best I can say.
Q: Okay and are you being paid?
A: Yes.
Q: Do you still retain the title of pastor at your former parish?
A: No.
Q: In terms of admin, if you need, you know, to be reimbursed or something like that, who do you-
A: The Vicar for Clergy Office.
Q: Who is that today?
A: Monsignor Michael Meyers.
Q: What was the last time you saw Michael Baker?
A: In my office as Vicar for Clergy in the earlier part of 2000.
Q: When did you first meet Michael Baker?
A: In the fall of 1972, when I entered St. John’s Seminary.
Q: And in what capacity was he at St. John’s?
A: He was a student there, a deacon. I was a first year student.

(Baker was ordained, Loomis was a first year student, so they didn't know each other. Loomis says he never had contact with Baker again until he was Vicar for Clergy, “Other than we might have attended the same meetings. But I have no specific recollection of anything.”)

A: I know he and Monsignor Dyer were friends.
Q: Were they classmates?
A: Yes.
Q: How did you know that?
A: Monsignor Dyer told me. In the transition period.

(Dyer was Vicar for Clergy before Loomis.
Wonder what made him bring up Baker then?)

Q: What was the Archdiocese policy in or around 1996 regarding placement of priests who had offended children sexually in the ministry?

(There’s some argument over semantics then:)

THE WITNESS: I don't remember the specific policy. I don't think there was one that I remember even reading that talked specifically about people involved with minors being in or out of ministry.

(Whoa, Loomis must be studying answer evasion from Bill Clinton. So when did the future Vicar for Clergy, whose job was among other things handling sex abuse claims against priests, learn there was a policy about pedophiles? )

MANLY: When is the first time you can recall ever learning that there was a policy in place regarding the placement of priests who had sexually molested minors in the ministry?
WOODS: Hold on. I am going to object. Assumes facts not in evidence that there was a policy and it doesn't state the policy very clearly. But I’ll let him answer.
THE WITNESS: The only policy that I'm aware of was a policy that was put out approximately 1987 or so that dealt with sexual misconduct by clergy and outlined a process for addressing them.
Q: Okay. When did you first learn that Michael Baker had molested a child?
A: During the transition period, when I was coming into the Vicar for Clergy office.
Q: So sometime in 1996?
A: It would have been 95 I think.
MANLY: And who told you?
A: I was told by three people actually in different - I don't know if you call them briefings or not. But I asked to talk to different people. Monsignor Dyer, Bishop Thomas Curry, and Cardinal Mahony.
Q: When you learned this, were you surprised?
A: Yes I was. It wasn’t something that I was expecting to hear.
Q: What did Monsignor Dyer tell you?
A: He told me that because Michael Baker had self disclosed that his case had been handled somewhat differently than other cases.
Q: Okay. Wait. How many cases were there?
A: I don't know at that point.
Q: Did they give you a briefing on alleged perpetrators within the Archdiocese?
A: Not a briefing on - as such going down. There were all of the different people. I did take a period of time where I reviewed some of the files.

(Is it just me or do you hear a lie and then an attempt to recover in the above?)

Q: How did the Baker name come up?
A: I don't remember the specific situation.
Q: How old was the child that he abused?
A: I don't remember.
Q: I mean did you wonder why, if he did that, he wasn’t in jail?
WOODS: I'm going to object. Calls for speculation. I’ll let you answer.
MANLY: You can answer.
THE WITNESS: I don't think I can answer that. I don't know. I didn't specifically reflect on that.
Q: Did the thought ever occur to you? You know molesting a child was a crime, right?
A: Yes.

WHY WASN’T BAKER IN PRISON A LONG TIME AGO?

Q: And you're in charge of the priests and somebody tells you a priest molested a child. Did the thought ever cross your mind, why isn’t this guy in prison?
A: I was not in charge at that time.
Q: Did you ever ask the Cardinal or Bishop Curry or Monsignor Dyer?
A: No. Not in that time frame, no.
Q: Did you ever ask them?
A: There was- toward the end of my time as Vicar for Clergy there was- I made a suggestion that the police should be called.
Q: Did they do that?
A: No.
Q: Who did you suggest that to?
A: To the Cardinal.
Q: Did he tell you why he wouldn't do it?
A: I was told that Michael Baker had submitted a hand written letter asking for laicization that the Cardinal was to forward to Rome.

(CofA: All they care about is their own little insular world.)

TWO MEN FROM ARIZONA
LOOMIS: It was toward the end of my term as Vicar for Clergy after the lawsuit involving Arizona came.
MANLY: There were two boys in Tucson? You suggested calling the police regarding those two children, correct?
A: It was after that, while Michael Baker was on leave and out of the ministry, we discovered that he had performed three baptisms which he did not have permission to do. And at that point I said, you know, there is no cooperation here, we ought to take further action.
Q: Who else was present, if anyone, when you suggested that to the Cardinal?
A: The suggestion was made by memo.
Q: And did he respond?
A: Yes. He wrote on the memo. And initially his response was to proceed. But then through the General Counsel’s office I heard that he had received that letter from Baker and that we were going to wait.

IS THERE A GRAND JURY INVESTIGATION GOING ON IN LA?

Q: Have you been asked to testify in front of a grand jury?
A: No.
Q: At any time?
A: There was a grand jury on a totally different matter up in Ventura County.
Q: When Sister Judy told you the Cardinal's suggestion was rejected, did she do that by phone, mail, email?
A: Face-to-face. I went to her office and she told me. I went to tell her what I was going to do and she told me that she had received instructions that reverse that.
Q: You told her you were going to call the police?
A: That I asked the Cardinal and he had said proceed. And then I was instructed to wait.

'DON, I DON'T BELIEVE THAT NONSENSE'

STEIER: The record should reflect that a moment ago, John, you used the term children and we all know that at the point in time we're talking about that everybody was an adult, and there is no legal requirement to make reports. There may be moral issues but not legal issues.
MANLY: Don, you ask what you want. I don't believe that nonsense.
STEIER: I'm talking about what the law says.
MANLY: You want to interrupt my deposition, do it on your own time.

(Back to deposing Monsignor Loomis: )
Q: Did you ever hear that Monsignor Dyer and Father Baker would take road trips to Tucson?
A: No.
W: Did Dyer have some contact or connection in Tucson that caused him to go there on a regular basis?
A: I’ve already said that I don't know that they were doing those.
Q: Have you ever heard that he and Banker were traveling in a car together in Tucson?
A: No.
Q: From Los Angeles?
A: No.
Q: Did Dyer and Baker socialize?
A: I don't know.
Q: They lived in the same house at St. Columbkille?
A: Yes.
Q: Did it ever come to your attention while you were Vicar for Clergy or anytime thereafter that Baker had a boy living in the rectory with him?
A: No.
Q: That Michael Baker was associating with a youth who was from Nepal?
A: No.
Q: Have you ever heard that from anyplace?
A: No.
Q: What were the restrictions on Baker with regard to him being around children, from the time you got to the Vicar for Clergy until Baker was suspended from ministry?
A: He was not to be around minors.
Q: Did you ever receive reports that Baker was around minors when you were Vicar for Clergy?
A: Right at the beginning of my term.

BAKER WAS NOT TO BE AROUND MINORS, BUT HE WAS

Q: When you heard this, I take it you were concerned?
A: I was.
Q: And were you concerned because you knew he had molested a child before? And because it was very clear to Father Baker that he was not to be around kids, right.
A: Yes.
Q: Yet he had a kid in the rectory sitting on the landing of the stairs? Yes.
A: Something along those lines. Minors were not supposed to be in the living space in any rectory.
Q: Period?
A: Period.
Q: In your mind, was this a big deal?
A: It was of concern, yes. I reported it to the Cardinal and once we had heard back from the meeting with the young man that it was apparently what we now call a boundary issue, rather than an abuse issue, at that point it was taken to the Sexual Abuse Advisory Board for their input.

(CofA: On a boundary issue, not a sex abuse issue, you call the Sex Abuse Advisory Board?)

Q: Who was on the board at the time?
A: I'm not sure that I can name everybody. The Sexual Advisory Board didn't make decisions or recommendations. We simply took the advice that the individual people chose to give and that became part of what I would put together as a recommendation to the Cardinal, not in terms of ascribing specific comments to specific people or anything of that type.
Q: Did anybody on the board recommend somebody call the police?
A: No.

THE BIG 8
MANLY: Did you ever hear, Monsignor, when you were Vicar for Clergy or thereafter, the term “The Big 8” being used to discuss certain priests accused of sexual misconduct in the Archdiocese?
A: No.

TUCSON
Q: Were there any other boundary violations after 1996?
A: No, not until we came to the Tucson lawsuit.

Church tap dances in Baker case to prevent discovery. Defendants include Mahony and the Paracletes. Hearing next week

*
By Kay Ebeling

The Witness: It was Lent. Father Baker was on the right hand, I was on the other side of Father Mahony- I mean Cardinal Mahony was giving the Mass, and my brother and my sister were on the other side of him. We just had good moments and - it started off very nice.

Q: Was that before the abuse?

A: Yes.

That Mass was in 1995, long after Cardinal Mahony knew of Michael Baker's pedophilia. Yet here is Mahony serving at the altar with Baker while Luis C and his siblings are altar servers, the plaintiff said in a recent deposition.

When Luis C and two other men told the L.A. District Attorney about the sex crimes in 2007, finally there was a report that fell within the Statute of Limitations, and finally the pedophile priest went to prison. Baker had confided in Mahony that he had sex problems with children back in 1986, both men of the cloth admit. In fact, by the time Baker preyed on Luis C, he had been sent, by Mahony, to Servants of the Paracletes in New Mexico for treatment of pedophilia.

Yet here is the Cardinal, right there watching, even sharing the altar, with Father Baker, as a new family of children from the parish are put within the pedophile priest's easy reach.

UPDATE: Docs released last night from a different Baker civil case could affect the hearing next Tuesday

"Release of items to the media before trial" is the main reason church attorneys will argue next Tuesday that all documents in the Luis C. civil case regarding former Father Michael Baker have to be protected, sealed. "They'll get out to the public before a trial," is repeated throughout the Motion for Protective Order filed July 6, 2009, on behalf of the L.A. priest.

Funny thing is, around midnight last night the Assocated Press reported on another civil case where two men make charges against Baker and Mahony, saying: "The claims were based on the recent deposition of former vicar for clergy Monsignor Richard Loomis. A transcript of the deposition was attached."

A transcript of the deposition of Loomis was attached!

Plaintiffs in another case that names Mahony and Baker attached a document that the Church was trying to keep secret and sent it to the world, just days before the first pre-trial hearing in the Luis C case takes place next week. Which means now the Judge can just throw up her hands and say, oh, well-

In the age of the Internet, it's impossible to keep the truth from coming out. Motion denied.

Good thing some of the Baker docs are coming out, because as I'm reading the defense motion to keep everything secret, that claim "Until Trial" is astounding. Throughout the world, the Catholic Church's modus operandi for handling civil cases regarding pedophilia is to fight and fight as long as possible up to the trial date, then around midnight the night before jury selection, the Church suddenly is amenable and wants to settle.

So they never get all the way to trial. Which gives them the advantage of never having to admit guilt.

Now with the Motion for Protective Order to be heard next Tuesday, the Church wants to never have anyone ever find out about any evidence at all concerning Michael Baker.

Tuesday's hearing on Motion for Protective Order is still on calendar for 11 AM, barring unexpected developments...

From L.A. Superior Court Website:

09/22/2009 at 11:00 am in department 324 at 600 South Commonwealth Ave., Los Angeles, CA 90005, Motion (MOTION FOR PROTECTIVE ORDER)

Having admitted he's paid by the L.A. Archdiocese years ago, Donald Steier knocks out legal briefs so fast and in so many pages, he must be using voice activated software. Steier appears in court for every L.A. Catholic pedophile priest who needs a lawyer, both civil and criminal.

July 9, 2009, Steier re-emerged, this time trying to prevent discovery in the developing civil case regarding former priest Michael Baker in L.A. Superior Court.

Again, the docs speak for themselves, as we quote freely below from Steier’s request for a “Protective Order” trying to keep secret everything that has anything to do with Michael Baker. The pedophile priest is currently serving out an eight and a half year sentence in a California state prison for sex crimes he committed against children when he was a Los Angeles Catholic priest.

Plaintiffs respond with their opposition to a protective order, and Steier chimes right in days later with another bulging brief, this time, opposition to opposition to motion for protective order, or something like that.

Baker through his attorney is asking the Court for protection based on:

Right to privacy in the state of California
Therapist patient privilege
Mediation privilege
Settlement privilege
Privilege against Self Incrimination

(Oh that wonderful Fifth Amendment, remember Steier is also the attorney who told George Rucker to plead the fifth over and over again as reported here last month.)
First Amendment right to free exercise of religion

Steier chimes in his own “declaration” that he “will work with all counsel before the hearing on the motion, in an effort to arrive at a mutually agreeable procedure to resolve the claims of privilege…”

Wonder how that went.

Quotes from Steier below show the gibberish with which the Church Attorneys, because they can, flood the court and play games with the judicial system, even taking advantage of the United States Constitution:

Citing patient therapist confidentiality, Steier writes, “This privilege is nearly absolute. A handful of narrow exceptions exist, such as ‘dangerous patient.’”

Dangerous Patient?

Isn’t a serial pedophile a dangerous mental patient?

Penitent's Privelege is in the Personnel File?
Baker asserts his right “to prevent disclosure of a wide range of spiritual discussions, therapy, redirection, and related wholly religious matters which may be mentioned” in the records.

Steier cites the “Penitent’s privilege,” where anything said in a practice like Confession where “the discipline or tenets of the denomination has a duty to keep those communication secret." He then says, “Some of those items within defendant’s personnel records include statements protected by that privilege.”

Huh?

If they're privileged and secret under tenets like Confession, what are they doing in his personnel file?

More Steier stuff: “Defendant is both a party and, as the holder of the privileges for the information contained within his personnel records, an ‘affected person’ with the standing to bring a motion to protect the contents of his personnel records.”

Huh?

The motion to keep Baker’s evidence secret “Seeks to prevent ANY disclosure” and if the court does order some records to be disclosed, “An order preventing the public disclosure” until the evidence is entered during a trial.

Right, keep the docs secret until a trial.

Then they never let a trial happen, that's their MO. In city after city across the country, the Church always settles civil cases the night before trial, allowing them to keep all those documents secret-

In perpetuity, so they think.

Steier compares pedophile priest Baker’s situation to cases where corporations claim personnel records are private in “Discharge and discrimination” lawsuits. The court must weigh in defendant's right to privacy, Steier claims.

Unabashedly misleading.

Manly Stewart for the plaintiffs respond:

We “oppose defendant DOE 3’s motion for Protective Order on the grounds that the information sought is not protected by any of the rights / privileges asserted and because plaintiff’s right to discovery is sufficient to overcome any such protection.

“Doe 3 (Father Michael Baker), arguably one of the most prolific and notorious sexual abusers to ever don a Roman collar, is currently serving a ten-year prison sentence, in part for brutally raping then-minor plaintiff over the course of several years,” reads the Introduction of Opposition to Motion for Protective order filed by plaintiffs.

Baker has “molested several victims in the past, admitting such to senior Archdiocese leadership during a church service in 1986, importantly, the head of the Archdiocese Doe 1 (Cardinal Roger Mahony).

“He was allowed to remain in ministry nevertheless, where he later abused Plaintiff.”

At the Lenten service where Mahony, Baker, and plaintiff were on the altar together: Mahony watched Baker “interact with the altar boys under his command and did not say a word.” If Mahony had acted during that Lenten Mass: “Plaintiff’s sexual abuse would never have occurred.

“Calling this an important case would be a severe understatement,” write the plaintiff attorneys about their case.

The Most Important Clergy Abuse Case the Archdiocese Has Ever Faced

More Quotes from Plaintiff’s Opposition to Protective Order:

“This is the most important clergy sexual abuse case the Archdiocese has ever faced, important because it contains among its cast of defendant characters, the head of the Archdiocese and its most prolific pedophile.

“Through the Motion for Protective Order, Defendants are attempting to prevent Plaintiff from establishing that they ‘knew or should have known’ of Doe 3’s [Baker’s] illicit sexual proclivities towards minors and failed to prevent it.”

There will be a hearing on this motion Tuesday September 22nd in Judge Emilie Elias’ court, after continuances took place through the summertime.

The Luis C Case #BC376766 names as defendants the Los Angeles Archdiocese, Cardinal Roger Mahony, Michael Stephen Baker, Servants of the Paracletes, and several other religious institutions as defendants.

So of course the Catholic Church is doing somersaults and conducting tap dances in courtrooms, closets, and sermons from the altar, doing everything it can to keep from the public record the truth about Michael Baker’s crimes and those of the Church Hierarchy who enabled them.

New Michael Baker case moves forward, and missing Victim Impact Statement from sentencing hearing of the pedo-priest finally gets posted
Pedophile Priest Michael Baker is one of a thousand John Doe’s in a lawsuit now working its way through Judge Emilie Elias’ Court, filed in Los Angeles August 29, 2007. Four months later...

************
Michael Stephen Baker will be eligible for parole August 18, 2011.

Baker is at a California Correctional Institution, is subject to transfer, and seems to be getting transferred often. Baker’s sentence on December 3rd 2007 ended up being eight and a half years, after time served. In California there is no parole hearing where victims can speak unless the convict had a life sentence.

But you can send Victim Impact Statements to Office of Victim and Survivor Rights and Services, PO 942883, Sacramento, California, 94283-0001. Refer to his CDC # F96146, and his birth date, which is 12/26/1947.

Read the timeline then answer these questions:

Why has Pope Benedict revived the cover-up?

What gives the Church the right to deal with cases privately?

What's now being done about current abuse cases?

Are predatory priests being quietly defrocked, ejected back into civil society, with no record or tracking as sex offenders?

Or are they being transferred once again to avoid exposure and allowed to continue to prey in distant locations?

Father Rucker, what are you hiding by invoking the Fifth Amendment over and over again?

*
By City of Angels

Went document diving last month, and found this gem filed in March 2006 by Donald Steier, attorney for George Neville Rucker, a priest with numerous pedophile accusations from the L.A. Clergy Cases settled in 2007. The “Defense Separate Statement of Issues" argues that the predator priest has the right to invoke the Fifth Amendment over and over again, by virtue of the fact that Rucker has invoked the Fifth Amendment in the past over and over again. I found the document in the L.A. Supeior Court Archives downtown.

Most of the 172 pages of the brief are direct quotes from a deposition of Rucker, the time and location of which is unidentified, but several attorneys for both sides were present, as well as several of Rucker’s accusers. In all 165 pages or so of transcript, Rucker answers one or two questions: benign ones, such as, yes, he’s seen that report, but then no comment on what the report says. Every other question asked of Rucker, his attorney instructs him not to answer, invoking the Fifth Amendment to the U.S. Constitution right not to incriminate himself, as well as the Sixth Amendment rights to privacy.

As so often is the case with sex crimes in the Catholic Church, the legal documents tell the story, no need to editorialize on my part, or even give character notes, as you can sense the personalities between the lines as the deposition takes place. Beginning with the first question where, on “Father Rucker’s Assignments, Residences,” Anthony DeMarco, liaison attorney for the plaintiffs asks, “Where was your first assignment out of the seminary?”

MR. STEIER: I'm going to object on a number of different grounds, primarily the Fifth Amendment. If I might make a statement with regard to the Fifth Amendment, we won’t need to repeat it each time in the future that I state the Fifth Amendment.
MR. DEMARCO: Please.
MR. STEIER: If there is any possibility of a tendency to respond in a manner that would incriminate the witness, he may invoke his Fifth Amendment. It requires a liberal application and especially when I’ve not been provided discovery.
He is not going to respond to anything that would provide a link in the chain of evidence that could possibly tend to incriminate him or lead to a clue. He need not acknowledge who he knows or corroborate the existence of any fact that could be in that link of chain.
I won’t have him answer questions that in m mind could lead to a possibly of incrimination.
Therefore, if you're asking him where he was assigned, in any assignment, it would be akin to asking somebody who was at a shooting in wedding where you have witnesses and maybe video, to answer whether they attended that wedding. And of course the problem with that is if you went to a trial in a criminal context and the witnesses were not available to be called and the video was seized illegally under the Fourth Amendment, the response of your client saying, “I went to that party” might tend to incriminate him.
So if you understand in that context why you don't place people at scenes or in relationships or provide corroboration, you can understand the reasoning that I’ll be employing this afternoon.
Having said that, I'm going to instruct my client not to respond, to remain silent, and in this case, I'm going to ask you to read the document that I’ve placed in front of you.
THE WITNESS: (GEORGE NEVILLE RUCKER) I assert my right to remain silent and decline to answer that question.
Q: BY MR. DEMARCO: You assert your right under the Fifth Amendment?
MR. STEIER: Yes.
THE WITNESS: Yes.
MR. DEMARCO: I’d like to put on the record also that you referenced 803 G as a possible source of criminal liability. As you're probably well aware, the court, the Supreme Court of the United States in Stogner versus the State of California ruled that acts committed many years in the past could not be revived for criminal liability under the ex post facto provisions of the Constitution.
Therefore, acts which occurred during the time frames that the lawsuits now pending address would be not subject to criminal liability, and the statute of limitations has run on those. I am unaware of any accusations being raised of any conduct which has occurred at Sacred Heart in Los Angeles.
So just with regard to Sacred Heart I would have a hard time understanding why that might fill in a missing link.
I’d also like to point out on the record that aside from communication a few minutes before we went on the record today, I was not informed in any detailed fashion as to the extent to which you would be claiming the Fifth Amendment here today, nor the legal basis for doing so.
So with that said, not having the precise legal authorities brought to my attention ahead of time, it was a little more difficult to engage in a sufficient meet and confer before this deposition commenced.
MR. STEIER: Are you finished with that?
MR. DEMARCO: yes, sir.
MR. STEIER: Let me just say a couple of things, and again I think it will be helpful. The Statement I made is quite consistent with the response filed in the Coughlin matter. …
MR. DEMARCO: Sejas was not cited to my recollection in the Coughlin case, was it?
MR. STEIER: I believe it was, but you know what, it is what it is.
Number 2, the statute of limitations with regard to alleged conspiracies, I don't know if that has run or not, and I am not in a position to assume it has. More importantly, and I think most instructively, the case of Michael Wempe will be of help here.
Wempe was in exactly the same position that George Rucker finds himself. All Michael Wempe’s cases were also, were dismissed pursuant to the decision in Stogner. In that case there was some anger about the man being released from jail pursuant to Stogner, and in that case a young man came forward with what I can only claim is a false allegation because we know Michael Wempe has passed several lie detector tests where -
Mr. MANLY: That's enough. We're not doing that. That's not - you're not putting that on the record so you can get it into the public domain.
MR. STEIER: Let’s just say this. Even a false claim, if there were one brought in this case, could lead to prosecution, which we know. And under those circumstances we know the district attorney has and would use any statement that they made to prosecute a person charged in the future.
It would include any statement he would make here today. Or in Wempe’s case, if he had made a statement in his deposition, they would be using that against him in the current prosecution. And it doesn't have to be a righteous claim. It can be any claim.
MR. DEMARCO: That said, there’s no evidence presented, you've presented no indication that there’s any claim that's been made that under the U.S. Supreme Court ruling in Stogner would be permitted under 803G to be brought criminally. So there is no outstanding criminal allegation against him.
MR. STEIER: I have no discovery; so I'm not the man to ask. Number 2, I have not been made privy of investigations that have been conducted by the police because they very seldom run them by me. So my job is to think of a possibility.
And the court used that. The court itself used this standard in relating to confessions, whether or not information related to whose confession was heard. And he said it’s possible that there could be a policy that the archdiocese has, and it goes on to come up with some theory that might have been and that would justify knowing whose confessions were taken.
I'm using the exact standards that Judge Fromholz uses. I'm trying to think of the possibilities that exist, not necessarily being made privy to the details.
MR. DEMARCO: would it be a fair statement to say, Mr. Steier, that you're going to object to any further questions directed in any manner to his assignment history?
THE WITNESS: That's correct.
MR. STEIER: and you will follow my instructions and not answer the questions.
THE WITNESS: Yes.
MR. DEMARCO: So any question about where he worked as a priest you will object and instruct him not to answer on the Fifth Amendment?
MR. STEIER: Yes, that's correct.

(CITY OF ANGELS: Throughout this deposition, Steier sounds like he thinks this is all a game. “I won,” he’s smirking.)

MS. FREBERG: Mr. Steier, does that also include any reasons why he was assigned to a particular position?
MR. STEIER: If the reasons were to be dealing with anything that arguable would be relevant to our concerns, that is by hypothetical, if he were reassigned because of a problem that he had in an area that affects the lawsuits, then obviously I wouldn't let him talk at all about any conversations at all.
That's the distinction I have to draw. And if it didn't have anything to do with that, then it probably wouldn't be terribly relevant to these proceedings.
Mr. LEIB: My name is Daniel Leib. I represent two plaintiffs in Clergy 1 (cases later moved to San Diego). Mr. Rucker is a named defendant in both cases. I’d like you at this time to at least put on the record what your understanding is of any information concerning any threats of prosecution of your client as you are aware of them today. I’d like you to list for the record any knowledge you have of any threat or actual particular threat of a prosecution.
You had mentioned that there’s a grand jury-
MR. STEIER: Yes.
Mr. LEIB: - forming but if you could do that right now, so we could clarify the record.
MR. STEIER: Anything relating to the grand jury quite frankly I'm not really privy to release.
On the other hand, it’s an ongoing investigation and they don't share all their details with me. If you're asking whether or not I'm aware of a current investigation involving my client, I could say that I know there’s an ongoing grand jury. I’ve been told that they are including more than the original two that we have fought in the appellate courts.
And they have not advised me anymore detail at the district attorney. I’ve asked but I don't get an answer. So I'm not privy to respond to it. I can say that I'm not actively aware or defending him in any criminal matter. I can say that. But I also can say I would have said the same thing about Michael Wempe, and the fact there speak for themselves.
MR. DEMARCO: He asked you to state all your basis for thinking there may be a threat of criminal prosecution. Have you done so?
MR. STEIER: I'm not going - to answer the question more accurately, and I could, (but it) would require me to explain to you why I'm concerned about my client here today, and where I see his risk as distinguished from answering is there a specific investigation or name. I have a legitimate concern about risk.
Mr. LEIB: Risk is not the standard though.
MR. STEIER: Incrimination is the standard and all I know is we've got civil complaints. We've named him as a party. They're alleging criminal conduct. Conspiracy alone would be enough for me to take the position, but I'm not standing on conspiracy alone.
I'm standing on the combination of conspiracy and ongoing potential problems and always will be subject to future prosecution. That's the best I can do to answer.
Do I have a legitimate reason to be concerned? I have reasons that I worry about at night, but nothing I can share without going into violating my client’s privileges.
I hope that answers it as best you can.
Mr. LEIB: It doesn't but we have a record.
MR. STEIER: thank you.
Q BY MR. DEMARCO: At any point in time after you graduated from Saint John’s did you reside at 611 North Marengo?
MR. STEIER: You can answer that question.
THE WITNESS: I came home for summer vacation.
Q BY MR. DEMARCO: When was that?
A: It would be the summer of, the summer of 41, 42, 43, 44, 45.
Q: You went home - you lived at 611 North Marengo each of those summers?
A: Yes.
Q: For how long a period of time each summer?
A: From beginning of June ‘til beginning of September.
Q: And did you attend Saint Andrews in Pasadena during those summers?
MR. STEIER: You can answer.
THE WITNESS: You mean -
Q BY MR. DEMARCO: Either as a deacon or as a parishioner?
A: A parishioner yes.
Q: Did you ever attend there as a deacon?
MR. STEIER: Could I inquire what the relevance would be of this? Does this have anything to do with these allegations?
MR. DEMARCO: Absolutely. I'm looking to find out where he was at and who he would have served with.
MR. STEIER: I'm sorry, I thought you were asking if he was a parishioner somewhere.
MR. DEMARCO: The second question was whether he served there as a deacon and that's the question I believe that's pending.
MR. STEIER: And that's relevant to these allegations in some way?
MR. DEMARCO: OH yes, certainly it will lead to discovery of possibly other witnesses to Mr. Rucker and who he knew.
MR. STEIER: Under those circumstances, I'm going to advise him not to answer that question. Because I'm not privy to other witnesses. I don't know what you know. I don't know what they are going to say and I don't want my client to acknowledge knowing them. So under those circumstances, I'm going to instruct you not to answer that question.
MR. DEMARCO: I'm not going to go-
MR. STEIER: Read that.
THE WITNESS: I’ll assert my right to remain silent and decline to answer that question.
BY MR. DEMARCO: Under the Fifth Amendment?
A: Yes.
MR. DEMARCO: Would it be a fair statement, Mr. Steier, to say that any questions directed at Mr. Rucker t relate in any way to other individuals or possible witnesses you will object to on the Fifth Amendment?
MR. STEIER: That is correct. That would be correct.
MR. DEMARCO: So any folks, any priests that he was assigned with at any of his assignments you will instruct him to take the Fifth Amendment
MR. STEIER: That would be correct for the reasons I’ve already stated.
MR. DEMARCO: And any nuns that he was assigned around at any parishes, asking any details about their identities you will object and instruct him not to answer based on the Fifth?
MR. STEIER: Anything that would tend to corroborate or acknowledge their existence I would instruct him not to answer.
MR. DEMARCO: And the names of any parishioners at any parish that he’s ever been assigned at, asking any questions relating to them, you will instruct him not to answer the question based upon the Fifth Amendment, is that correct?
MR. STEIER: Yes, yes.
MS. FREBERG: Before we move forward, I think in order to make a clear record in regard to recent comments made by Judge Fromholz, as to every area where Mr. Steier is directing the witness not to answer based upon the Fifth and by Father Rucker taking the Fifth, I think we probably need to do a stipulation on the record. That we stipulate that the parties 0 that we do not have to ask the complete realm of questions as to each of the subject matters.
MR. DEMARCO: Mr. Steier, as to each of the subject areas which we've just been addressing in which you've indicated you will be taking the Fifth, can we have a stipulation on the record that we do not need to ask every single possible question that we might had you not taken the Fifth broadly?
MR. STEIER: Yes the areas that we just discussed included where he was assigned, who hd knew at those assignments, including both parishioners and co-workers, and although not asked, probably residents where he resided during those periods of time.
I would think any of those would clearly require me to instruct him to take the Fifth Amendment. And I would join that stipulation.
MR. DEMARCO: So stipulated? Anyone else have any objection to that stipulation? Hearing none, I’ll go on.
Q BY MR. DEMARCO: Why did you retire?
MR. STEIER: I'm not going to allow him to answer that question.

We are now only at page 20 OF 172 from Defendant George Neville Rucker document filed March 2006: Statement in Opposition of Motion to Compel Depo of Father Rucker, filed by Donald H. Steier or Guzin & Steier, 4525 Wilshire Boulevard, Suite 201 (note they are still in the building that used to be owned by the Archdiocese, and reportedly the building was sold in order to help pay for the 2007 settlements. Now the building is owned by someone who rents the offices to the Archdiocese.

Continued

Before the Deposition Tanscript begins, the introduction states:

Defendant George Neville Rucker submits the following Separate Statement of Issues in Opposition to the Motion to Compel his answers to deposition questions.
This case (the 2007 civil cases against Rucker) involves specific allegations that defendant is involved in an ongoing criminal (defendant’s emphasis) conspiracy to obstruct justice, cover-up felonies, and other illegal acts. The criminal SOL for such allegations has not expired.

In addition, extensive public statements have been made, including by the District Attorney of Los Angeles County and others working in law enforcement, that they suspect such a conspiracy exists, and they will prosecute whatever the evidence may show.
Clearly any answer to any pertinent question could incriminate defendant, and thus, his assertion of the Fifth Amendment must be sustained.

An answer need not be directly incriminating to be covered by the Fifth Amendment, but answers are also protected by the Fifth Amendment where they might provide a link in a chain of evidence against a defendant, or provide a clue that could lead law enforcement to find evidence.

Further, Evidence Code 1108 provides for perpetual presumptive admissibility of sexual offenses, even for which the statute of limitations has expired, in the prosecution of any future sexual offense.

Defendant has never waived and is not placing medical or psycho therapeutic procedures in issue, and the assertion of priviliege must be sustained.

Defendant also asserted his constitutional Right of Privacy. Plaintiffs have failed to demonstrate a compelling need for such disclosure, nor have they shown that there is no less intrusive means available, both as required by law.

Finally, under the unique facts of this case, the global stay prevented defendant’s attorney from following his typical practice to prepare for the deposition by prohibiting him from conducting discovery.

Thus he cannot be adequately prepared to let defendant be questioned on matters that almost certainly will find their way into the prosecutor’s hands, because of the ongoing, intimate level of cooperation and sharing of deposition transcripts between the civil attorneys here and interested prosecutors.

This document was filed in March 2006
CONTINUED:

MR. STEIER: I'm not going to allow him to answer that question.
MR. DEMARCO: Based upon the fifth?
MR. STEIER: Based upon the Fifth yes. The Fifth, the Sixth, right of privacy. And you'll follow my instructions, won’t you?
THE WITNESS: Yes.
Q BY MR. MANLY: Who was the pastor at Saint Agatha’s when you served there?
MR. STEIER: I’ll instruct my client based on our prior conversation not to answer questions that could tend to incriminate him and he’ll follow my instruction.
Q: Have you ever served with anybody as a priest who later became an auxiliary bishop or a bishop, without telling me where you served?
MR. STEIER: I'm going to instruct him not to answer the question. The reason - let me tell you my reasoning behind that. There are so very few auxiliary bishops that if an auxiliary bishop were to come forward to say I had the following conversation with George Rucker at some place, I think that would, because of the nature, tend to provide a link in the chain.
I'm going to instruct you not to answer that question.
MR. MANLY: I'm not asking him if he had conversations with somebody who was already a bishop. I'm simply asking did he ever serve with anybody as a priest who later became bishops.
MR. STEIER: I do understand the j. As asked, again, there are very few who later became bishops.
MR. MANLY: There’s a boatload, Don, who became archbishops or bishops in this diocese. They're all over the country.
MR. STEIER: I'm going to instruct him now not to, but I suspect we'll have another opportunity to meet, and if-
MR. MANLY: can I have the instruction?
MR. STEIER: I'm going to instruct him not to answer on the Fifth Amendment.
Q BY MR. MANLY: Can you read it, Father? Father, are you alright? You seem to be grabbing your nose. Are you okay?
A: Yes, I assert my right to remain silent and decline to answer that question.
Q: Who was the pastor, who were some of the pastors you've served under, Father?
MR. STEIER: I'm going to instruct as previously directed pursuant to the Fifth Amendment, right of privacy, Sixth Amendment. You're instructed not to answer that question. You can read the statement.
THE WITNESS: I assert my right to remain silent, decline to answer that question.

********
Invoking the Fifth and refusing to answer goes on for questions about his work record, or anyone he worked with... Katherine Freberg, another plaintiff attorney present, asked an interesting question:

Q BY MS. FREBERG: Did you work with Father Harry Trauer at any time?
MR. STEIER: he’s not going to answer who he worked with. I’ll instruct him not to answer pursuant to the Fifth Amendment.
MS. FREBERG: I understand, Don, that you have entered into a stipulation with liaison counsel that all questions relating to assignments are preserved eeven though we don't ask every specific question here?
MR. STEIER: yes.
MS. FREBERG: I had a few questions that I wanted to ask about documents that were produced by the Archdiocese of Los Angeles. These are documents from the personnel file of Father Rucker.
May I have a stipulation that all of those questions relating to any documents produced by the Archdiocese of Los Angeles related to Father Rucker are preserved at a later time after a motion to compel and that I don't have to repeat or ask every one of these questions here now?
MR. STEIER: Yes, I agree to that stipluatino. And I would just add that we have litigation still pending with regard to some of the personnel files that are involved and that you referenced. So those are unresolved as we sit here. But a part of it goes to the Fifth Amendment, yes.
And I’d also incorporate any written objections that I filed regarding personnel filed if and when those are appropriate.
MS. FREBERG: And the basis for your objecting and instructing your client not to answer any questions that any of the plaintiff lawyers may have regarding documents produced by the Archdiocese regarding Father Rucker is the Fifth Amendment?
MR. STEIER: Yes.

MORE QUESTIONS WITH NO ANSWERS THEN
FINALLY RUCKER GIVES AN ANSWER:

Q BY MS. FREBERG: Father Rucker, have you ever read the proffer that the Archdiocese of Los Angeles prepared in relation to you?
MR. STEIER: I'm going to let you answer. Did you ever read the proffer?
THE WITNESS: I only read information that my lawyer gave me.
Q BY MS. FREBERG: Do you know what I mean by a proffer?
MR. STEIER: You can answer that question.
THE WITNESS: I'm not sure what it is legally.
MS. FREBERG: There was a document prepared by the Archdiocese of Los Angeles that outlined your various assignments. It also provided information regarding allegations that you had molested little girls.
That’s the document that I'm referring to when I say “proffer.” Did you ever review that document?
MR. STEIER: To the extent that it would have been something that he got through his counsel, then he’s not going to answer that question.

I WAS WRONG, I THOUGHT HE FINALLY ANSWERED A QUESTION, BUT IT WAS JUST A STALL.
They show Rucker the proffer then:

MS. FREBERG: Mr. Steier, it is my intent to ask various questions regarding this proffer. Is it going to be your instruction to Father Rucker not to answer any questions?
MR. STEIER: Yes it is, and let me just put on the record my thinking on that too. As I look at this document, it reflects, other than the ordained date and the born date, it reflects assignments, it reflects police investigations of abuse, it reflects complaints regarding abuse. And therefore, and other than the alst entry which deals with where he is in residence currently, they would all be invasive of the Fifth Amendment. And therefore I would be compelled to go ahead and have him invoke the Fifth. . .
MR. DEMARCO: I'm not sure, but from looking at what I see in front of Ms. Freberg, that appears to be what was available publicly.
MS. FREBERG: I think it was.
MR. STEIER: In any event, I object to him answering any questions related to the subjects I just went over.

More of the same then:

B: Reasons Why Further Responses Should Not Be Ordered:

This case involves specific allegations that defendant is involved in an ongoing criminal conspiracy to obstruct justice, cover up felonies, and other illegal acts. Etc.

2: Father Rucker’s Personal Interests and Hobbies, Questions and Answers:

Q: Father Rucker, while you were an active priest, did you have any hobbies?
MR. STEIER: I'm going to instruct him not to answer… I don't know what charges have been made… as farfetched as that may sound to the lay mind, from a legal point of view, from a criminal legal point of view, I'm very comfortable in asserting-

THE WITNESS: I assert my right to remain silent. I decline to answer that question on the basis of the Fifth Amendment.

It goes on like that for another 140 pages.

EXAMPLE, of Church Attorney’s arrogance in mutilating the American Justice System to protect pedophile priests and other perversions:

MR. DEMARCO: Father Rucker, have you ever cooked your own meals?
MR. STEIER: You can answer that question. See, I'm not unreasonable.
THE WITNESS: in cases of emergency.
Q BY MR. DEMARCO: only in cases of emergency? I'm sorry?
A: When maybe the cook got sick or some such.
MR. STEIER: Okay you've answered the question.
MR. DEMARCO: Would it be a fair statement then to say that cooking has never been a hobby of yours?
MR. STEIER: What would the relevance be of that question?
MR. DEMARCO: There’s certainly personal activities at issue in these cases that that might bear relevance upon and I'm not going to go any further on that.
MR. STEIER: I don't understand how cooking a meal goes to notice. If it does, then I’ll probably instruct him not to answer, because obviously there’s something I don't know.
ANOTHER EXAMPLE:
MR. DEMARCO: I'd like to mark as Exhibit 2, a photo, class photo, and I’d ask that the witness take a look at it for a moment.
MR. STEIER: You can look at it but don't say anything. … the pictures are people who could potentially be witnesses, and his mere acknowledgement would be incriminating.
Finally after 48 pages of this:
MR. DEMARCO: I want to make sure we have on the record the date that this deposition was agreed to between liaison counsel, presumably with Mr. Steier, which I'm fairly well aware had agreed to the date more than a month ago. The letter you referenced and attached as an exhibit to the deposition in no way says your client is going to be taking the Fifth as to the vast majority of any testimony he might offer today.
MR. MANLY: Just for the record, I want to make clear, I'm not done. I'm not saying you're right to assert objections. I understand what you're doing and you're a very good lawher.
But this is the second time that basically we've come to a deposition and brought victims. And you don't have to accept their allegations as true.
But just out of sensitivity to them, it sure would be nice - and I'm not saying you did it intentionally, I'm not; I think others have but you haven’t.
I will just ask that you and counsel for his eminence just be sensitive to that.
We went to a lot of expense to fly somebody in here. Had I known it was going to be handled this way, I wouldn't have done it. and I would extend you the same courtesy.
MR. STEIER: And to that extent, in the future I'm going to do my very best to communicate that a little better. … what I'm trying to do is listen to each question and invoke as I feel right. If it was going to be a blanket invocation of the Fifth Amendment, I would have immediately notified everybody that he’ll answer no questions. I have attempted here to answer questions - we can disagree-
MR. MANLY: I think the Archdiocese once again, just for the record, I think there’s a pattern and practice of basically making people travel a long way with absolutely no intention of having them give a deposition. And I think you set the date. You knew this was going to happen. It’s wrong.

MORE ASSERTIONS OF FIFTH AMENDMENT TO MORE QUESTIONS, then:

MR. DEMARCO: can we get a stipulation that any questions in any way relating to any activities he might have engaged in relating to sexual abuse of children, that you're going to instruct him not to answer based upon his Fifth Amendment rights?
MR. STEIER: Most assuredly.
MR. MANLY: Father, Rucker, my name is John Manly and I represent the lady in the red sweater down there and (NAMES THREE WOMEN WHO ARE PRESENT). That lady alleges that you molested her as a little girl. Did you do that.
MR. STEIER: I'm going to instruct my client not to answer that question for the Fifth, the Sixth, the right of privacy.
MR. MANLY: Did you ever work with Mary S after she became a nun?
THE WITNESS: I assert my right to remain silent…
MR. STEIER: I might add with all due respect, Mr. Manly, that you can rest assured that every question dealing with specific misconduct will receive the same response.
MR. MANLY: I'm just making my record.
MR. STEIER: I'm just telling you that.
MR. MANLY: I'm not surprised.
MR. DEMARCO: That's for all victims?
MR. STEIER: All victims.
MR. MANLY: Father Rucker, did you ever place your hand or finger inside Mary D’s vagina?
MR. STEIER: I'm going to instruct him not to answer…
MR. MANLY: Father Rucker, did you ever at Saint Agatha’s stand out in front of the school on a walkway where the boys and girls had to go by and stop girls and put your hand down their shirt and in their panties?
MR. STEIER: I'm going to instruct my client not to answer…
…
MR. MANLY: Did you know -

THE WITNESS (FATHER GEORGE RUCKER) CONTINUED TO REFUSE TO ANSWER QUESTIONS ABOUT SPECIFIC PLAINTIFFS, SOME OF WHOM WERE IN THE ROOM
Examples:

MS. FREBERG: Father Rucker, what was the most flagrant act of molestation that you ever committed?
MR. STEIER: He’ll be instructed not to answer that pursuant to the Fifth Amendment.
Q: Hi, my name is Arthur Goldberg and I represent a series of people from Saint Agatha Church and I want to ask you background questions. Do you see the woman sitting at the end?
THE WITNESS: I do.
Q: She was sitting next to me.
THE WITNESS: Yes.
Q: Do you know who she is?
MR. STEIER: I'm going to instruct him not to answer…
Mr. GOLDBERG: The Fifth Amendment, meaning that the answer to whether he knows the woman who just stood up could tend to cause him to have criminal charges filed against him?
MR. STEIER: No. Could tend to incriminate him, yes.
Mr. GOLDBERG: So how would a person knowing another person cause incrimination even potentially?
MR. STEIER: If a person makes an allegation against you and you acknowledge knowing that person, then you tend to corrobarte that, yes, he even knows that person. It’s possible he could be, he could have committed the crime that she also is alleging. That information subsequently could be used pursuant to 1108 in a subsequent prosecution pursuant to 803 G.
Mr. GOLDBERG: So the theory is by merely knowing someone, according to your exercise in the Fifth Amendment, that is sufficient to exercise the Amendment?
MR. STEIER: Under the circumstances of this case, absolutely correct. . . It’s one more link in the chain to tend to corroborate and support allegations..
********
GOLDBERG does not have any better luck with Steier getting Rucker to answer:
*****************
GOLDBERG: You're saying by identifying that person, it could show some form of overt act in its very nature to carry out a conspiracy, merely by identifying the person in this case?
MR. STEIER: A link in the chain, that's the standard, that's right.
Mr. GOLDBERG: For the record, I do not believe that is the law, and I believe that that link is so unlinkable that it cannot cause identity without more evidence, and there’s been no showing here today of the possibility of that, of the conspiracy. But I’ll make that for the record and we'll go on.
MR. STEIER: Thank you.
THE WITNESS: I assert my right to remain silent.

More Examples of obfuscated justice:

Mr. GOLDBERG: Did you ever pay tuition for the three K sisters when the mother said that the father was out of work, in order to keep them in your presence, if you will, at Saint Agatha’s Church?
THE WITNESS: I assert my right to remain silent.
Q: Did you ever have a confrontation with the girls’ father in 1974 or 75 at which time he accused you of molesting J, one of his daughters?
THE WITNESS: I assert my right to remain silent.
Q: Did you then leave immediately the next day the parish and not return?
A: I assert my right to remain silent…
MR. STEIER: Let me just make a note here. some of these answers might very well be no’s. We are in a position right now, we can’t say no without running the risk of somebody claiming a waiver [of the 5th Amendment right]. So that's an unfortunate situation we're in.
Mr. GOLDBERG: And some of the answers might be yes.
MR. STEIER: That's would be the reason for the Fifth Amendment.
Mr. GOLDBERG: It would be the reason to find out the truth of what's going on.
MR. STEIER: Right. We can’t draw that distinction unfortunately.
Mr. GOLDBERG: Mr. Rucker, were you ever known as Rub A Dub Rucker at Saint Agatha’s school during the 1970s when you were there?
MR. STEIER: I'm not going to allow him to answer that question as…
Mr. GOLDBERG: One last question in all seriousness, Mr. Rucker, did you feel at times when you were at St. Agatha’s Church that you sort of lost control of yourself? That you found it difficult not to sexually molest the young girls at the school.
MR. STEIER: Same objection. …

MORE:

Q: Father Rucker, when was the first time anyone from the Los Angeles Archdiocese or anyone affiliated with them brought to your attention accusations that you had sexually molested a minor?
MR. STEIER: I'm going to instruct him not to answer…
MR. DEMARCO: Father Rucker, have you ever allowed a minor to be alone with you in any rectory?
MR. STEIER: He’s been instructed not to answer…
Q BY MR. MANLY: Father Rucker, presently do you have a canon lawyer?
MR. STEIER: That might be a right of privacy, I don't know if the attorney-client privilege attaches.
MR. MANLY: Even if it does, the fact that he has one or not isn’t privileged.
MR. STEIER: Well no, but here’s the problem. If he were to have a canon lawyer, the link in the chain would be that he has a reason to have a canon lawyer because there would be a process against him.
MR. MANLY: That's not true. There could be all sorts of reasons to have a canon lawyer.
MR. STEIER: I have to err on the side of being liberal in my interpretation, and therefore I'm going to have to instruct him not to answer if he has a canon lawyer.
MR. MANLY: Were you assigned to predominantly African American and Hispanic parishes because you were an abuser?
MR. STEIER: I'm going to instruct him not to answer that question, I think it’s argumentative.
Q By MR. MANLY: Did you ever receive telephone calls from Cardinal McIntyre about complaints?
MR. STEIER: To the extent that I'm presuming it’s relevant to these proceedings, I'm going to instruct him not to answer.
Q BY MR. MANLY: Isn’t it true the Archdiocese knew you were an abuser before you were ordained?
MR. STEIER: I'm going to instruct you not to answer….
Mr. HABEL: Argumentative and harassing
MR. DEMARCO: And the judge has already indicated that we can’t cross examine witnesses in deposition. He said that in a recent order.
Mr. HABEL: I don't object to the form.
MR. MANLY: What's harassing about it, Counsel? Let’s deal with this now. What's harassing about it?
Mr. HABEL: I made my record, objection for the record, I'm not going to debate it.
MR. MANLY: This is for trial. I want to know what the basis is for the objection so I can correct the question. The reality is there is no basis.
Q: Father Rucker, isn’t it true that you abused children when you were a seminarian?
MR. STEIER: I'm going to instruct him not to answer.
MR. MANLY: Father Rucker, isn’t it true that Cardinal Mahony knew you were an abuser when he placed you in the ministry, in faculties at a parish located in Palos Verdes, Corpus Christi Parish?
Mr. HABEL: Lacks foundation, calls for speculation, assumes facts not in evidenc.
MR. STEIER: I will instruct him pursuant to the Fifth Amendment not to answer…
MR. MANLY: Let me ask you this. Who was the chancellor of the Archdiocese when you retired?
MR. STEIER: That assumes a fact not in evidence that there was a chancellor, but if you know the answer to the question you can answer it.
THE WITNESS: I can’t remember. There have been so many.
MR. MANLY: John Rowden knew you were abusing children, didn't he?
MR. STEIER: I will instruct my client not to answer that question.
Mr. HABEL: Lacks foundation calls for speculation…
MR. MANLY: Isn’t it true, Father Rucker, that it was not a secret while Archbishop Levada was serving in the Archdiocese that you were a child abuser and a molester?
Mr. HABEL: Argumentative, harassing.
MR. STEIER: It assumes a fact not in evidence, but more importantly I’ll instruct him not to answer pursuant to the Fifth Amendment.
MR. MANLY: Isn’t it true that Archbishop Levada knew you were a child molester?
Mr. HABEL: Calls for speculation, lacks foundation.
THE WITNESS: I assert my right to remain silent.
MR. STEIER: My client now doesn't need me to instruct him anymore, he’s beginning to get it.
MR. MANLY: How good for you.

LATER:

MR. MANLY: Monsignor Connolly knew you were an abuser, did he not?
MR. STEIER: I'm going to object to that. I'm going to instruct my client - I'm going to object to that and instruct my client pursuant to the Fifth Amendment…
MR. MANLY: Father Rucker, who at the Archdiocese was aware at any time of the fact that you were abusing children, molesting children?
Mr. HABEL: Assumes facts not in evidence, calls for speculation, lacks foundation.
MR. STEIER: I will instruct him not to answer pursuant to the Fifth…
MR. MANLY: Father Rucker, are you aware of anybody at the Archdiocese ever reporting you to law enforcement prior to 2001?
MR. STEIER: I'm going to instruct him not to answer per Fifth Amendment.
Mr. LEIB: What's the nature of the objection?
MR. STEIER: Fifth amendment, why did I object?
Mr. LEIB: Yes.
MR. STEIER: Was he aware that he was reported for child molestation?
Mr. LEIB: Right, how does that implicate his Fifth Amendment rights?
MR. STEIER: Hypothetically, let’s say he was aware that somebody had made a report, and then that person comes forward and says, you know I made this report about George Rucker. My client would be, by admitting that or acknowledging it, would be adding a link in the chain of evidence to incriminate him…
MR. MANLY: Did Monsignor Hawks ever talk to you about allegations that you had abused children?
MR. STEIER: On that question I have to instruct him not to answer. . . .
Q BY MR. MANLY: So, Father, isn’t it true that when Father O’Dowd was pastor at Saint Alphonsus that he repeatedly told you to stop touching children and molesting children?
MR. STEIER: I’ll instruct him not to answer…
MR. MANLY: Isn’t it true that Father O’Dowd reported you to the Archdiocese?
MR. STEIER: I’ll instruct him not to answer that question.
MR. MANLY: Isn’t it true that Father O’Dowd was well aware that you were abusing girls at Saint Alphonsus in Los Angeles while you were an associate there?
MR. STEIER: I’ll instruct my client not to answer…
MR. MANLY: Did Mother McGrury at Saint Alphonsus School talk to you about abusing kids?
MR. STEIER: I’ll instruct my client not to answer…
MR. MANLY: At any point during your career were priests assigned to you to supervise your aftercare because of sexual abuse?
MR. STEIER: I'm not going to let him answer that question…
MR. MANLY: When did Cardinal Mahony as far as you know first know that you had abused children on a massive scale?
MR. STEIER: It assumes a fact not in evidence
Mr. HABEL: Calls for speculation…
Q: Are you aware that the Los Angeles Archdiocese has publicly confirmed prior allegations of sexual molestation involving you?
MR. STEIER: I don't know what the relevance of that would be… It’s a good question but I'm going to instruct him not to answer…
[much back and forth then]
MR. MANLY: Do you deny, wait a minute, do you deny that the Archdiocese has acknowledged that he’s an abuser?
Mr. HABEL: We're not going to get into it.
MR. MANLY: Wait a minute. No, I'm making my record. You're saying they're just allegations. You publicly acknowledge and the proffers acknowledge that he’s an abuser. Do you deny that or not?
Mr. WOODS: I stated an objection to the question. The phraseology is vague and ambiguous.
MR. STEIER: I'm going to instruct him not to answer…

And it doesn't ever get any better, all the way to the end. All you get from George Neville Rucker is: I assert my right to remain silent.

MR. STEIER: I'm going to let him answer that question. Did anybody ever teach you it was wrong to have sex with a child at the seminary? Yes or no?
THE WITNESS: yes.
MR. MANLY: Who?
THE WITNESS: The Moral professor.
MR. MANLY: Who was that?
THE WITNESS: Moral Theology.
MR. STEIER: That's it.
THE WITNESS: I can’t remember.
MR. STEIER: He doesn't remember the name of the moral professor. He remembers the moral lesson though.
MR. MANLY: How many lectures were there on not having sex with kids by the moral professor at Saint John’s Seminary?
MR. STEIER: I’ll let you answer that question.
THE WITNESS: The course on the Sixth Commandment lasted a whole semester and took up everything.
MR. MANLY: And the Sixth Commandment is Thou shalt not commit adultery?
THE WITNESS: Right.
MR. MANLY: There was an entire semester course on the Sixth Commandment?
THE WITNESS: I think so.
MR. MANLY: Now, sex with a child falls under the Sixth Commandment, yes, Father? Not having sex with a child falls under the Sixth Commandment?
MR. STEIER: I'm going to raise the objection… [MUCH DISCUSSION THEN]
MR. MANLY: Did anybody teach you in formal education setting, Father, when you and your classmates were there, that there are disciplinary consequences for priests who abuse children sexually?
MR. STEIER: You're talking about at the seminary level?
MR. MANLY: yes.
MR. STEIER: I'm going to let you answer.
THE WITNESS: Not that I remember.

SAVING THE BEST FOR LAST:
Questions on Rucker’s interactions with
LAW ENFORCEMENT:

MR. MANLY: If they gave him his Fifth Amendment Miranda rights and they say did you do it, and Father Rucker says yes, I did it, I abused these kids, there’s no Fifth Amendment privilege. It’s waived. I don't know whether he did or didn't, but I want to know the answer.
MR. STEIER: The answer is the Fifth Amendment. I'm going to instruct him not to answer.
Mr. LEIB: Have you ever been convicted of a felony?
MR. STEIER: He’s not going to answer that question, it would tend to incriminate him.
Mr LEIB: Don, that's absolute fundamental discovery.
MR. STEIER: You can answer that question.
THE WITNESS: No.
Q: Have you ever been charged?
MR. STEIER: That's not relevant to anything. .. you have less intrusive ways of getting the answer. Get it somewhere else, not here. If a court orders us to answer that question, we'll answer that question.

MR. MANLY: What you're doing really, saying somebody else might have committed another crime and just because of that, then anybody could take the Fifth, that's not an appropriate use of the Fifth. That's not the law.
And I think at this point, and I mean this with all due respect, you're a part of the defense strategy that the Archdiocese and the Cardinal have put forth, which is don't let anybody answer any questions which might implicate the Cardinal, and that's what this is about today.
MR. STEIER: Mr. Manly, you may perceive that to be what I'm doing. the truth is I'm protecting my client’s interests and if it does overlap with anybody else’s interest, it is of no moment to me.
However, we are in a very unique situation when we are in the area in California dealing with penal code statutes for sexual abuse. There is no statute of limitations.
There is the door open at any time in his lifetime, in my client’s lifetime, for somebody to make allegations. And if those allegations are made, they will be used against my client in a criminal prosecution.
It’s a propensity statute. How many propensity statutes are there in the state of California? There are very very very few. So we are in a very unique situation here that doesn't apply to most situations.
I understand your argument and in most situations it would have more weight in my mind than it does today. Because of the statutes, as crazy as they are, I have to be very liberal in my application. I'm required to do so by the law, and I'm doing so here today.
Because of the conspiracy counts being alleged, I have to instruct him not to answer this question. Those counts should be dismissed, it would be my advice but go ahead. I'm instructing him not to answer and he’ll follow my instruction.

Well, Rucker is now living at Nazareth House on the tony west side of Los Angeles. Would someone from law enforcement please give him immunity and pick him up for questioning?

POST NOTE: Re the Bishop of Scranton resigning:

The church can no longer pretend it does not believe in Fibromyalgia or other PTSD-induced crippling conditions after the Bishop of Scranton gave his reason for early retirement:

Martino, 63, said he was suffering frequent insomnia and sometimes "crippling" fatigue, and felt he could no longer lead effectively.

Guess what. A high percentage of the TENS OF THOUSANDS of Catholic Priest Sex Crime Victims suffer from "crippling fatigue" and insomnia.

When do I get sent to a retreat for a few years to recover?

Why isn't the Church helping the crime victims as much as it helps the criminals?
